This website is operated by BobaBit. The following terms govern the use of our online shop and all related services. By accessing our website or placing an order, you agree to these terms and conditions.
§1 Scope
These Terms and Conditions apply to all orders placed via our online shop www.bobabit.eu by both consumers and business customers.
§2 Conclusion of Contract
- The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
- By clicking the order button, you submit a binding order.
- The contract is concluded only with our express acceptance (order confirmation by e-mail).
§3 Prices and Payment
- All prices are stated in euros and include statutory VAT (where applicable).
- Shipping costs are shown separately before completing the order.
- Payments can be made in advance, by credit card, PayPal, or instant transfer (Klarna).
- For orders on invoice, we reserve the right to conduct a credit check.
§4 Delivery
- Delivery is made within Germany and to other EU countries unless otherwise agreed.
- Delivery times are usually 2–5 business days from receipt of payment.
- If items are unavailable, we will inform you immediately.
- Deliveries to other countries are possible only upon prior agreement.
§5 Right of Withdrawal
Consumers have a 14-day right of withdrawal. The exact conditions can be found in our Withdrawal Policy.
§6 Retention of Title
The goods remain our property until full payment has been made.
§7 Warranty and Liability
- Statutory warranty rights apply.
- Food products cannot be returned once opened.
- BobaBit is liable only for intent, gross negligence, or breach of essential contractual obligations.
- Liability for damages resulting from injury to life, body, or health remains unaffected.
§8 Business Customers (B2B)
- Different terms apply to business customers.
- Returns or withdrawal are only possible by individual agreement.
- We accept no liability for damages resulting from improper resale of goods.
§9 Data Protection
Information on the collection, processing, and use of personal data can be found in our Privacy Policy.
§10 Jurisdiction and Applicable Law
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- For merchants, the place of jurisdiction is Egenhausen.
- For consumers, the statutory place of jurisdiction applies.
